Bessemer Hostel Guest Agreement


 Hostel guests are responsible for any damages that they cause.  Guests are required to promptly report all damages that they are aware of, whether they have caused them or not. Hostel guests also agree to refrain from taking anything from the hostel that is not theirs. Chad Kister is the sole owner, manager and employee of the hostel and property at 4592 Bessemer Rd.; Nelsonville OH 45764.

 Chad Kister is the only person allowed on the west side of the house (the side toward Conner Rd.), or near the north door of the 1st floor of the house. The hostel reserves the right to charge credit or debit cards for various additional damages, for various things, including, but not limited to, use of additional bunk beds, moving or removing beds, etc. All mail for guests must be in care of Hostel Owner Chad Kister.

 Hostel guests are forbidden from entering Chad Kister's personal habitation, on the first floor of the main house (with the hostel being defined by the second floor of the same house, as clearly marked with hostel on both outside doors). Chad Kister also retains access to the hostel.

 Only Chad Kister, and his dog are permitted to enter the first floor or the stairwell of the main house. Guests are also required to report anyone other than Chad Kister who has entered Chad Kister's first floor primary personal habitation, at any time, whether or not they know their identity, to Chad Kister. Anyone except Chad Kister with the intention of entering the first floor of the main house, with the second floor being the hostel is permanently banned from the property.  Anyone other than Chad Kister who thinks that they have permission to enter the first floor is permanently banned from the property.

 Smoking, candles, oil lamps and incense are not allowed in the hostel.

 The structure near Bessemer Road is referred to as Bessemer Place, and nobody but Kister or those which he specifically allows are permitted in that structure. Guests are required to report the entry by anyone into that structure, the storage shed or the old outhouse to Chad Kister. The hostel does not provide refunds. Guests agree that the Bessemer Hostel is intended for transient guests and landlord tenant laws do not apply.  The hostel reserves the right to hold guest's property until all payments, including costs for any damages or extra use of the hostel, are paid in full.

 Please be respectful of other people's items, and do not consume anyone else's food or beverages without their permission. Also, to keep this hostel affordable, please help to clean after yourself.

Also, hostel guests agree not to use any chlorine or vinegar in the washing machine and to get permission before using it. Guests are not allowed to bring pets on the property. Guests agree to stay on the stairs and paths specifically authorized in person for use by guests by Chad Kister (the path around the east side of the house, and the path to the forest (along the clothes line and keep going straight). Chad Kister is not selling, trading or giving the property at 4592 Bessemer Rd.; Nelsonville, Ohio away, but instead is allowing guests to stay at the forest paradise temporarily.

   By signing this document, the guest agrees to the Bessemer Hostel Lodging Agreement that is in the desk drawer on the second floor. Guests agree to not turn away other customers. All guests of yours must register with hostel owner Chad Kister.  If any portion of this agreement is deemed unenforceable by a court, the remainder of the agreement remains intact.

Bessemer Hostel Lodging agreement

FOR GOOD AND VALUABLE CONSIDERATION, the Bessemer Hostel, an unincorporated charitable endeavor, offers affordable lodging to environmentally conscious travelers interested in protecting Author and Film Maker Chad Kister from harm, and his primary personal habitation (on the first floor of the main house) from entry by anyone but Chad Kister.  It is the second floor that is the hostel.

Bessemer Hostel guests do hereby mutually convent and agree:
Those residing in the hostel are temporary guests, not tenants. 
Hostel guests are responsible for any damages that they cause, and they are required to promptly report all damages that they are aware of, and those who caused them, whether they have caused them or not. Guests are also required to report all entry into Chad Kister's primary personal habitation, or any unauthorized area by anyone other than Chad Kister to Chad Kister. Hostel guests also agree to not do any searching through other people's belongings. Chad Kister is the sole owner and manager of the hostel. 
Please stick to the paved stairs or the driveway. Only use the paths that Chad Kister authorizes for guest use (The main trail around the east side of the house by the largest pond, and to the national forest).  Do not enter the first floor of the main house, anywhere near the first floor west side door, or any other area  west of the house (the side toward Conner Rd.), including near the north door of the first floor of the house.
Hostel guests are forbidden from entering Kister's primary personal habitation, on the first floor of the main house (with the hostel being defined by the second floor of the same house. Kister also retains access to the hostel). Nobody but Chad Kister is permitted to enter the first floor or the stairwell of the main house. Guests are also required to report anyone other than Chad Kister who has entered Chad Kister's primary personal habitation (the floor below the hostel), at any time, whether or not they know their identity. 
The structure down on Bessemer Road is referred to as Bessemer Place, and only Chad Kister is permitted in that structure, and guests are required to report the entry by anyone other than Chad Kister into that structure to Chad Kister.
Please be respectful of other people's items, and do not consume anyone else's food or beverages other than that which is in the free food cupboard, as clearly marked.
To keep this hostel affordable, please help to clean after yourself. 
Also, hostel guests agree to get permission, and follow necessary rule before using the washing machine or clothes line.

2. Rooming house lodging and hostel guests

a. This Contract is for living space in the second floor of the main house and bedroom number _______, and Cot or bed number _________ (for shared rooms). The Bessemer Hostel reserves the right to assign the guest to a room and to change his or her room assignment. If the guest is occupying a multiple-occupancy room, this hostel reserves the right to assign and change his or her roommate(s). If a Bessemer Hostel guest wishes to make permanent improvements to a room, he or she may do so provided they are given prior written consent by Bessemer Hostel owner Chad Kister.

b. The Bessemer Hostel guest shall use the hostel only for residential purpose and shall not conduct any business or commercial enterprise therein. The Bessemer Hostel guest shall comply with all local, state and federal laws, ordinances and regulations with the rules and regulations, by-laws, policies and procedures of the Bessemer Hostel.

3. CHARGES:

a. In consideration for the living space, the Bessemer Hostel guest agrees to pay the agreed upon amount plus any amount due for damages, extra use, etc., and leave by noon of the date of termination of the contract.
b. The Bessemer Hostel guest shall pay to the hostel owner Chad Kister such individual charges as she or he may incur for optional goods and services.
c. Payment is required in full to reserve a bed or room.
d. Damage to a room or its furnishings beyond ordinary wear and tear, as determined in the sole discretion of the Bessemer Hostel management, will be charged to the Bessemer Hostel guest occupying the Room. Damage to room or property used in common with other guests will be charged to all guests equally unless the guest(s) responsible are identified by the Bessemer Hostel management. If responsibility for damage is acknowledged or decided by the Bessemer Hostel management as caused by one or more hostel guests, the damage will be charged to that hostel guest or those guests. Intentional damage will be reported to authorities for prosecution, and guests are responsible to report all damage to Chad Kister.

e. All sales are final.  The Bessemer Hostel does not provide refunds.   The hostel has a returned check fee of $40.   The guest agrees that damages can be charged to their debit or credit card, without prior permission.
f. The guest understands that all rates and charges are subject to change by the Bessemer Hostel.

4. ENCUMBRANCE: The Bessemer Hostel Guest (and his or her Parent or Guardian, if he or she is a minor) expressly agrees that at the request of the Bessemer Hostel, may encumber the guest for failure to pay, when due, all room rental, other charges charges, and damages that apply in court.

5. FINES AND PENALTIES: If the Bessemer Hostel guest fails to pay any sum under this contract to the Bessemer Hostel when it is due, he shall pay such fines or penalties as may be provided by the Bessemer Hostel, plus interest on the unpaid sum at the annual rate of eighteen percent (18%) (1.5% monthly), and all costs of collection, including reasonable attorney’s fees, which the Bessemer Hostel may incur in connection therewith. If the Bessemer Hostel guest fails to pay any sum under this contract to the Bessemer Hostel within one day of the date due, Bessemer Hostel may remove the guest.

6. Bessemer Hostel Guests RESPONSIBILITIES:

a. The Bessemer Hostel guest shall take good care of the House and its furniture, furnishings and equipment; shall keep them in neat, clean and orderly condition; shall permit no waste or damage to be committed in or upon them; and shall make no alterations or additions to the Bessemer Hostel without the prior written consent of Bessemer Hostel owner Chad Kister. Upon the expiration or other termination of this Contract, the Bessemer Hostel guest shall remove his or her personal property from the Hostel and shall peaceably surrender possession of the premises and property in clean condition and good repair, ordinary wear and tear resulting from careful usage alone accepted. After surrender of possession by the guest, the Bessemer Hostel shall have the right to dispose of or re-use any personal property left by the guest in or on the Bessemer Hostel premises, and the Bessemer Hostel shall not be responsible to the guest to account for the disposition of such property;
b. Cooking is prohibited in the individual rooms.
c. HAZARDOUS MATERIALS. Guests shall not keep on the Premises any item of a dangerous, flammable or explosive character that might unreasonably increase the danger of fire or explosion on the Premises or that might be considered hazardous or extra hazardous by any responsible insurance company. Radioactive material (excluding smoke detectors), x-ray machines, body scanners of any type, excessive electro-magnetic field generation, and microwave and directed energy weapons or devices are prohibited. Microwaves can only be used in the kitchen, and are forbidden in the bedrooms.
d. Recycling is required.

7. RIGHTS:

a. The Bessemer Hostel reserves the right to enter the Bessemer guest's room for the purpose of cleaning, housekeeping, inspecting the room and making such repairs, alterations, additions, and improvements as the Bessemer Hostel may deem necessary or desirable.  In the dorm room, the Bessemer Hostel may enter and check in other guests, and move belongings to help make space for other guests.

b. The Bessemer Hostel may terminate this Contract if the Hostel becomes uninhabitable.

c. The Bessemer Hostel may terminate this Contract and take possession of the guest's accommodation at any time after notice is given to the Hostel Guest if the guest fails to comply with any of the terms and conditions of this Contract. Such conditions include, but are not limited to, the following: (a) the Hostel Guest has violated any term of this hostel Contract; (b) guest misconduct as determined by the Bessemer Hostel management. In such event, the guest shall be responsible for any loss of revenue sustained by the Bessemer Hostel, and the hostel, at its option, shall be permitted to retain all sums paid to it hereunder by the guest to credit against any such loss of revenue, without limiting its rights to collect further loss of revenue and any other damages from the guest;

d. The guest shall not sell or assign this Contract without the prior written consent of the hostel. No modification of this Contract shall be effective unless it is made in writing and is signed by the guest, and the Bessemer Hostel owner, Chad Kister;

e. Rights and remedies of the hostel under this Contract shall be in addition to and cumulative of those provided by law.

8. WAIVERS AND/OR LIABILITIES:

a. The waiver of any violation or breach of any provision hereof shall not constitute a wavier of any subsequent violation or breach of either that same provision or any other provision hereof:

b. The Bessemer Hostel, its owner and employees shall not be responsible for any injury, loss, or damage to the guest’s property resulting from fire, theft, or other cause. Neither the guest nor the hostel carries any liability, casualty, or fire insurance on any personal belongings of the guest in the House. The guest shall insure any property that he or she brings onto the hostel premises against the risk of loss or damage;

c. The guest shall be jointly and severally liable for the guest's full and faithful performance of the terms and conditions of this Contract, including but not limited to the personal guarantee of the payment of any and all money now or hereafter owed by the guest pursuant to the Contract.


9. GENERAL PROVISIONS:

a. This Contract is made with reference to and shall be construed in accordance with the laws of the State of (Ohio), in which state it shall be performed by the parties. Any action arising under the terms and conditions of this Contract may be brought in any local, state or federal court located in the County of Athens, State of Ohio, having jurisdiction of the subject matter, and the undersigned parties hereby consent that any such court shall have personal jurisdiction over them with respect to any such action;

b. The guest shall comply with all local, state and federal laws, ordinances and regulation and with the rules and regulations, by-laws, policies and procedures of the Bessemer Hostel.
c.   if a term in the contract is deemed unenforceable by a court, the contract as a whole and the remaining portions will not be deemed unenforceable

10. TERM

The term of this contract is for that agreed upon only in writing.
